By Shannon Schweigert, Principal – GivingPoint

When it’s time to make a major charitable gift or consider a gift that has a life income option, who will you turn to for technical advice for your financial interests? The complexities of the tax code and ever-changing regulations regarding charitable giving make professional advice critical in making a sound decision.

According to a 2007 study released by the Bank of America, those who give call upon others to assist them in their gift decision making process. Of the individuals surveyed, 41.2% turn to fundraisers and nonprofit staff members first. Peers and peer network contacts were ranked next with 35.9%, followed by accountants at 26.6%, financial advisors at 16.6%, and attorneys at 16.4%.

I believe each of the professionals named in the study should play in pivotal role in helping donors formulate their charitable plans. Nonprofit fundraisers concentrate on the donor’s values as the foundation for inspired gift planning. Charitable gift planning is most successful when these wishes are then integrated with their assets. Bringing the team of financial, legal and tax advisors together can create the best possible financial scenarios for you, your family and your philanthropy.

The concept of nonprofits and a donor’s professional advisors working together has grown tremendously along with the instances of giving and the size of gifts. The collaboration has reaped tremendous benefits for all involved. Planned Giving Today reported in 2002 that 78% of persons who set up charitable life income plans such as gift annuities or charitable remainder trusts did so at the prompting of their professional advisor. The IRS reported charitable deductions rose by 35% between 1998 – 2004. This trend is expected to continue as the nation’s greatest transfer of generational wealth is poised to occur.

With the demographic shift of an aging population and unprecedented generational wealth transfer; stated to be $41 trillion nationwide between 2000 – 2050 by Boston College’s Paul Schervish and John Havens, the cooperation between nonprofits and professional advisors will be critical in developing tax-efficient wealth transfer plans that transfer more to a wealth owner’s family and favorite nonprofits. Sound financial planning, which integrates charitable giving, can greatly decrease family wealth erosion due to income and estate taxes. It is not a linear process. A positive change in one facet of your plan affects several others. To be assured all is in sync with your values; develop your plan with your favorite nonprofit gift planners, your legal, tax and financial advisors as well as your family

By Shannon Schweigert, Principal – GivingPoint

One of the greatest challenges for our retirement income plans is to create cash flow from illiquid properties. Often, retirees find themselves owning property such as farm land, vacation homes or commercial real estate that have increased dramatically in value but are producing little income. The low return on investment has not kept up with lifestyle changes, or inflation.

Selling the property seems the obvious solution; however many property owners are hesitant to do so because of the capital gains tax implications. There is a solution. Why not consider a Charitable Remainder Trust (CRT)?

The CRT is the only planning tool in the tax code that allows persons who are receptive to charitable gift planning four favorable outcomes by virtue of one financial transaction. Through a CRT funded with low return appreciated land or other property we are able to increase income, bypass capital gain tax, and receive a charitable deduction. And, most importantly, leave a sizeable remainder interest gift to our favorite nonprofit.

For example, John and Mary Jones are each 75 years old and own a quarter of farmland that pays them $9,200 in cash rent annually. The value of their land at $2,400 per acre was $184,000 This is a 5% return on its value. During their lifetime, John and Mary have always been very involved with their church. They wished they could make a special gift that was larger than their annual contributions. After discussing their position with the development director at their church, their financial, tax and legal advisors as well as their family, it was decided a charitable remainder annuity trust was the perfect solution for them.

After gifting their land to the church to establish a CRT, John and Mary received a guaranteed annual income payment of $12,218 for life from the CRT. This was $3,018 more than their cash rent. They also received a tax deduction of $56,175 and avoided the capital gains tax of $18,000 had they sold the land themselves. The effective rate of return on this transaction is 7.38%.

Most importantly, the Jones’ CRT will leave a projected $112,789 to their church after their deaths, assuming the CRT averages a 5.25% return over the Jones’ 17-year life expectancy.

For more information about gift planning concepts including the CRT discussed above, contact GivingPoint today. As with any financial decision, please involve your financial, legal and tax advisors.

By Lisa Jackson, Principal – GivingPoint

There are many ways to make a planned gift. For example, a Charitable Gift Annuity (CGA) is a common, simple form of planned giving. It is an excellent way to make a charitable gift while receiving lifetime income benefits and receiving a tax deduction. A CGA is a contract between a donor and a qualifying charity in which a transfer of cash or other property to the charity provides a fixed annual income for life for one or two individuals. After the lifetime of the donor(s), the charity receives the remainder interest of the original gift.

The payout rate is determined by the age of the annuitant(s) as well as the American Council on Gift Annuities suggested rates. When factoring tax savings, the effective rate of return for a CGA may be quite competitive or even greater than certificates of deposit or commercial annuities depending upon the age and tax bracket of the donor.

There are several tax advantages the donor may realize when establishing a CGA. First, a portion of each CGA payment to the donor is tax-free. Second, donors who itemize deductions can claim a charitable deduction for a portion of the original gift. This deduction may be used in the year of the gift and carried forward for five (5) additional years if necessary. Depending on the type of asset used to fund the CGA, either 30% or 50% of the donor’s adjusted gross income may be deducted annually until the total charitable deduction is exhausted. Third, donors funding a charitable gift annuity with appreciated assets may also be able to avoid capital gains tax.

Establishing a charitable gift annuity is a wonderful way to make a significant gift to your favorite non-profit organization while at the same time increasing your current cash flow with guaranteed, fixed income which is unaffected by interest rates or the stock market. Like with any financial decision, please consult your professional advisors before making any decision.

From 1990-96, Shannon served his alma mater in its admissions and development offices rising to the level of chief development officer in 1994. During that time, he increased alumni donor participation from 19% to 27%

From 1996 to 2003, he served as a registered investment advisor in the Fargo area, first at Foster Klima & Company and later at EideBailly Financial.

Shannon returned to Jamestown College to serve as vice president of institutional advancement and executive director of the school’s first-ever comprehensive capital campaign from 2003 – 2005. During his tenure, Jamestown College experienced two of its best fundraising years in school history. Under his leadership, $20 million was raised towards the campaign’s $34 million total.

Shannon joined Impact Foundation in 2005 as its vice president for development.
